1. Introduction
This Privacy Policy explains how Trinity CRM LLC, a Florida limited liability company doing business as CatchCRM ("CatchCRM," "we," "us," or "our"), collects, uses, and shares information in connection with the CatchCRM platform, websites, and related services (the "Service"). The Service is a business tool used by companies ("Customers") to manage their own customer relationships, field operations, messaging, invoicing, and estimates.
We play two different roles with respect to personal information, and this Policy addresses both. For information about our Customers and visitors to our own sites, we act as the data controller (or "business" under U.S. state privacy laws). For information our Customers upload or collect about their own contacts and clients ("Customer Data"), we act as a data processor (or "service provider"): we process that information only on the Customer's instructions and on the Customer's behalf.
2. Information We Collect
Account and contact information: name, business name, email address, phone number, and login credentials when you create an account or contact us.
Billing information: plan, transaction history, and payment details. Card numbers are collected and processed by our payment processor; we do not store full card numbers on our systems.
Usage and device information: log data, IP address, browser and device type, pages viewed, features used, and similar diagnostics, collected automatically when you use the Service, including through cookies and similar technologies.
Communications: messages you send to our support team and feedback you provide.
Customer Data: contact records, messages, call and text logs, call recordings, voicemails, transcripts, AI conversation logs, invoices, estimates, and other content that Customers and their authorized users submit to or generate through the Service. We collect this on behalf of the Customer, and the Customer controls it, including whether call recording and AI features are enabled and whether legally required notices and consents have been given to the people on those calls and chats.
3. How We Use Information
We use the information described above to provide, operate, secure, and support the Service; to process payments; to communicate with you about your account, updates, and service notices; to prevent fraud, abuse, and violations of our Terms of Service and Acceptable Use and Messaging Policy; to comply with law; and to improve the Service, including through aggregated, de-identified analytics that do not identify any person.
We do not sell personal information, and we have not sold personal information as those terms are defined under applicable U.S. state privacy laws. We do not use Customer Data to build our own marketing lists, to advertise to your contacts, or for the benefit of any other customer. We do not use Customer Data to train generalized artificial intelligence models.
4. Customer Data and the People Our Customers Contact
If a business you deal with uses CatchCRM, that business (not CatchCRM) decides what information about you is collected, why you receive its messages, and how long your information is kept. We process that information only as the business instructs. If you want to access, correct, or delete information a business holds about you in CatchCRM, or to stop receiving its messages, please contact that business directly. We will support our Customers in responding to such requests, and if you contact us directly we will identify the relevant business where we reasonably can and refer your request to it.
5. How We Share Information
We share information only as needed to run the Service:
- Service providers and subprocessors that help us operate the platform, such as cloud hosting, telecommunications carriers and SMS and voice aggregators, email delivery providers, AI model providers, payment processors, and analytics and support tools, each bound by contractual obligations appropriate to their role. Our agreements with AI model providers prohibit them from using your data to train their generalized models.
- Legal and safety: where required by law, subpoena, or legal process, or where necessary to protect the rights, safety, or property of CatchCRM, our Customers, or others, or to enforce our agreements.
- Business transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to this Policy or successor terms with comparable protections.
- With your direction: when you connect integrations or instruct us to share information with a third party.
We do not sell or rent personal information to data brokers, advertisers, or anyone else.
6. International Data Transfers
We are based in the United States, and information we collect is processed in the United States and in other countries where our service providers operate. Where we transfer personal information from the European Economic Area, the United Kingdom, or Switzerland, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses (and the UK Addendum or IDTA, as applicable). A Data Processing Addendum, including these safeguards, is available to Customers on request at office@catchcrm.ai.
7. Data Retention
We keep account information for as long as your account is active and as needed for legitimate business purposes such as billing records, dispute resolution, and legal compliance. Customer Data is retained while your subscription is active and for a limited period after termination to allow export, after which it is deleted or de-identified in the ordinary course, except where law requires longer retention. Customers can delete records within the Service at any time.
8. Security
We use administrative, technical, and physical safeguards designed to protect information, including encryption in transit, access controls, and logging. No system is perfectly secure, and we cannot guarantee absolute security. Customers are responsible for securing their own login credentials and for managing access by their users. If we become aware of a breach affecting personal information, we will notify affected parties as required by applicable law.
9. Your Rights and Choices
Depending on where you live, you may have rights over your personal information, which may include the right to access, correct, delete, or receive a copy of it, to object to or restrict certain processing, to withdraw consent, and to not receive discriminatory treatment for exercising your rights.
- EEA, UK, and Switzerland: You may exercise your rights under the GDPR or UK GDPR by contacting us. You also have the right to lodge a complaint with your local supervisory authority.
- U.S. states: Residents of California and other states with comprehensive privacy laws may exercise the rights those laws provide, including access, deletion, and correction, by contacting us. We do not sell personal information or share it for cross-context behavioral advertising.
- Marketing from us: You can opt out of our own marketing emails using the unsubscribe link in any such email. We will still send transactional and account messages.
To exercise any right, contact us at office@catchcrm.ai. We may need to verify your identity before acting on a request. If your request concerns information held in a Customer's account, we will refer it to that Customer as described above.
10. Cookies
We use cookies and similar technologies to keep you signed in, remember preferences, secure the Service, and understand usage. You can control cookies through your browser settings; disabling some cookies may affect the operation of the Service.
11. Children
The Service is a business tool and is not directed to children. We do not knowingly collect personal information from anyone under 16. If you believe a child has provided us personal information, contact us and we will delete it.
12. Changes to This Policy
We may update this Policy from time to time. If we make material changes, we will provide notice through the Service or by email before the changes take effect. The effective date above reflects the current version.
